Good afternoon, please find attached a notice of public hearing for a street vacation and the site map that shows where Stuart Road is located.
The City desires to vacate this right-of-way so that it can control it for purposes of establishing a wetland mitigation bank. In order to receive federal and state approval of the bank, the City is required to demonstrate that they have control over the bank properties so that future development is not possible and the underlying wetlands can be protected in perpetuity. Vacation of the subject right-of-way ensures that a street will not be built and that utilities or public access will not be installed within it. The City’s Parks and Public Works Departments have verified that this portion of right-of-way is not necessary in the future for any of those elements and that it should be protected for purposes of establishing the City’s first mitigation bank.
